Housing Rights as Texas Returns to School

Do any of the following apply to you:

  • Do you have kids that are attending school or college in-person?
  • Do you work at a school or college?
  • Has your landlord, neighbors, or Home Owners Association (HOA) treated you differently because you work in a school or college or have kids that attend a school or college?

This handout may be able to answer some of your questions.

Do I have to move if I got COVID-19?

I (or my kids) got COVID-19 or were told to quarantine because we were in close contact with someone with COVID-19 while at school. My landlord or HOA found out and said I have to move out or stay somewhere else. Can they do this?

No. A landlord or HOA cannot force you to move out because you or someone in your home has COVID-19 or because you are told to quarantine.

I work in a school and I’m told I have to stay home

I work in a school and my landlord, neighbors, or HOA says I cannot leave my home to check my mail or take a walk around the complex or neighborhood, but everyone else can. Can my landlord force me to stay in my apartment?

No. The landlord, neighbors, or HOA cannot treat you differently because they think you may have COVID-19. They cannot force you to stay in your home.

My kids attend school and I’m told we have to stay home

My kids attend school and my landlord, neighbors, or HOA says that I cannot leave my home to check my mail or take a walk around the complex or neighborhood, but everyone else can. Can they force me to stay in my home or apartment?

No. Landlord, neighbors, or HOA cannot treat you differently because they think you may have COVID-19. They cannot force you to stay in your home.

I’m being harassed because I work in a school

My neighbor knows I work in a school. They are harassing me when I leave my home saying that I should not be outside because they think I have or carry COVID-19. They will not stop harassing me. What do I do?

Let the landlord or HOA know in writing that your neighbor is harassing you and that it is because they think you have or carry COVID-19. Ask the landlord to tell the tenant that is harassing you to stop. The landlord has a duty to take action and tell the other tenant to stop the harassment.

I’m being harassed because my kids are back in school

My neighbor knows my kids are back in school. They are harassing my kids when they go outside and yelling or making mean comments that my kids should not be going outside. They will not stop harassing us. What can I do?

Let the landlord or HOA know in writing that your neighbors are harassing your kids because they think your kids have or are carriers for COVID-19. Ask the landlord or HOA to instruct your neighbor to stop harassing you. The landlord or HOA has a duty to take action and tell the other tenant to stop the harassment.

The situations above apply to all education professionals and students regardless of what you do in the school or the type of school (public or private, grade school or college).
